HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6486 OF 2017 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C by the petitioners/ accused, seeking to quash the proceedings in C.C.No.252 of 2016 on the file of the Additional Judicial First Class Magistrate, Ramachandrapuram, East Godavari District, where taken cognizance for the offences punishable under Sections 324 and 506 r/ w 34 I.P.C., which is an outcome of Crime No.141 of 2013 of Draksharama Police Station. Heard learned counsel for the petitioners and learned Public Prosecutor appearing for the State, before ordering notice to respondent No.2/ de facto complainant and perused the material on record including the police final report. Prima facie, there is nothing to interdict the post-cognizance proceedings before the learned Magistrate, but for, giving liberty to the petitioners in the course of hearing before charges, to raise all the defences available to them by filing discharge application under Section 239 Cr.P.C.
It is needless to say, in the event of filing of any application for one to represent others under Rule 37 of the Criminal Rules of Practice, it is for the learned Magistrate to consider and permit.
Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending if any, shall stand closed.
