HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5286 of 2015 ORDER:

This criminal petition, under section 438 of the Code of Criminal Procedure, is filed by the petitioners-Accused Nos.3 to 5 seeking grant of anticipatory bail in connection with crime No.99 of 2015 on the file of Hayatnagar Police Station, Ranga Reddy District, registered for the offence under Section 20 (b) of the Narcotic Drugs and Psychotropic Substances Act.

The case of the prosecution is that on credible information, the Inspector of Police, Haythnagar P.S., conducted search at Peddamberpet village, at outer ring road on NH 65 and apprehended the petitioners, who were bringing huge quantity of ganja from Rajahmundry, East Godavari District, to supply the same at Hyderabad and Narayankhed of Medak District and other States, in a DCM van bearing No.AP 27 X 8313. After completion of panchanama, police arrested the accused and seized the ganja. The total weight of ganja seized is 460 kgs. Basing on the mediators report, Crime No.99 of 2015 was registered.

Heard and perused the material available on record. A perusal of the record discloses that the seized ganja is about 460 kgs., which is more than the commercial quantity. Hence, this Court is not inclined to grant anticipatory bail to the petitioners at this stage.
