THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 18373 of 2012 ORDER:

This writ petition was filed for the following relief: "For the reasons stated in the accompanying affidavit, the petitioners pray that this Hon'ble Court may be pleased to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the impugned communication in R.C.No.5973/09/1-1, dated 12.04.2012 made by the 1st respondent to the 2nd respondent insofar as and to the extent of not excluding petitioners' 6 plots bearing Plot Nos.6, 7, 16, 17, 18 and 29 of Rishikonda Village, Visakhapatnam in L.P.No.36/2009 of Survey No.

34/1 for stopping further registration as illegal, arbitrary, capricious and without application of mind and violative of Article 300-A of the Constitution of India and consequently to set-a-side the same only to the extent of above 6 plots provided to the petitioners as alternative land for utilising the 1st respondent for formation of and extension of beach road from Visakhapatnam to Bheemunipatnam or to pass any other order or orders." Learned counsel appearing for the petitioners as well as learned Standing Counsel appearing for respondent No.1 submits that the issue raised in the present writ petition is squarely covered by the order, dated 12.12.2012, passed in W.P.No.23217 of 2012. In view of the same, this writ petition is allowed in terms of the order, dated 12.12.2012, passed in W.P.No.23217 of 2012.
