THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No. 16553 of 2014 ORDER :

The petitioners, who are accused Nos.1 to 5 in Crime No.234 of 2014 of Nagari Police Station, Chittoor District, filed the present application under Sections 437 & 439 Cr.P.C. seeking enlargement on bail in the above crime registered for the offences punishable under Sections 307, 353, 379, 411 r/w 120(b) IPC, Sections 29 & 32 of the A.P.Forest Act, Section 29 of the Wild Life Act, 1972, Sections 55(2) & 58 of the Bio-diversity Act, 2002 and Section 27 of the Arms Act, 2002. At the time when the matter is taken up for hearing, the learned counsel for the petitioners submits that though the petitioners were arrested on 17.10.2014 till date no charge sheet is filed. Whereas the learned Additional Public Prosecutor disputes the said fact. Having regard to the above, if the police have not filed charge sheet within the period stipulated under the statute, the petitioners, if so advised, are at liberty to move an application before the trial Court seeking bail and the same shall be dealt with, in accordance with law, at the earliest.
