CVNR, J CRP 2761/2017 ORDER:
This civil revision petition arises out of order dt.15.3.2017 in E.A. No.296 of 2016 in E.P. No.1 of 2016 in O.S. No.375 of 2010 on the file of the Principal District Judge, Visakhapatnam.
At the hearing, Mr. S. Subba Reddy, learned counsel for the petitioners, submitted that his clients would not have filed this revision petition but for the confusion relating to deposit of costs, i.e., whether they are liable to deposit E.P. costs or suit costs. He has further submitted that he has advised his clients to deposit the E.P. costs in view of the order of the lower Court which in express terms indicates only E.P. costs. He has also submitted that as the time for deposit of the E.P. costs has expired, the same may be extended. When the civil revision petition itself is not entertained, I do not find it appropriate to extend the time for depositing the E.P. costs. However, the petitioners are permitted to make an application before the lower Court for extension of the time. If such application is filed, the lower Court shall consider the same and pass order thereon.
Subject to the liberty given to the petitioners as above, the civil revision petition is dismissed.
As a sequel to dismissal of the civil revision petition, C.R.P.M.P. No.3639 of 2017 shall stand disposed of as infructuous. _______________________ C.V. NAGARJUNA REDDY, J 23-06-2017 bnr
