THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.15865 OF 2013 ORDER:

This Criminal Petition under Section 482 of Cr.P.C. is filed by the accused No.4 seeking to quash the proceedings in C.C.No.622 of 2013 pending on the file of III Metropolitan Magistrate, Cyberabad at L.B.Nagar for the offences under Sections 3, 4 and 5 of Prevention of Immoral Traffic Act, 1956 (for short 'the Act').

Admittedly, the petitioner herein visited the brothel house as a customer being run by the other accused. In similar matter, this Court in Crl.P.No.1786 of 2013 and batch by judgment dated 22.03.2013 held that the petitioners therein, who visited the brothel house as only customers cannot be prosecuted for the offences under Sections 3,4 and 5 of the Act. Following the same and for the reasons stated therein, this Criminal Petition is allowed and the proceedings in C.C.No.622 of 2013 pending on the file of III Metropolitan Magistrate, Cyberabad at L.B.Nagar are quashed as against the petitioner herein.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
