THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2099 of 2015 ORDER:

This revision is filed by the petitioner challenging the order dated 4.9.2015 passed by the VI Metropolitan Magistrate, Cyberabad, at Medchal in DVC No.10 of 2015.

The 1st respondent is the wife of the petitioner. She filed the above DVC against the petitioner and others seeking various reliefs. Pending the DVC, the Court below passed the order under revision, which reads as follows: "Both parties called absent, counsel for petitioner and respondents not argued the matter, heard, considering their arguments and also material documents of Medical prescriptions of the petitioner, directed respondent No.1 to pay the interim maintenance to the Petitioner an amount of Rs.10,000/- for Medical expenses and livelihood from the date of filing of this petition till the date of disposal of the main DVC."

Aggrieved by the above order, the petitioner filed this revision. As per Section 29 of the Protection of Women from the Domestic Violence Act, an appeal shall lie against the order under revision. In view of the same, the petitioner is directed to prefer an appeal before the appropriate forum. Registry is directed to return all the original papers to the Petitioner under proper acknowledgement.
