THE HON'BLE SRI JUSTICE T.AMARNATH GOUD CRIMINAL PETITION NO.8062 OF 2011 ORDER:
This Criminal Petition is filed under Section 482 of the Criminal Procedure Code to quash the proceedings in C.C.No.182 of 2009 on the file of the XIII Additional Chief Metropolitan Magistrate, Hyderabad under Section 498-A IPC and Sections 4 & 6 of the Dowry Prohibition Act. Based on the complaint made by the de facto complainant- first respondent herein, the police registered Cr.No.407/2007 and filed charge sheet for the offences under Section 498-A IPC and Sections 4 & 6 of the Dowry Prohibition Act before the Women Police Station, CCS, Hyderabad. It is brought to the notice of this Court that, in view of the family disputes with regard to partition of properties among the family members, the above crime has been registered and as a counterblast O.S.Nos.694 of 2007 and 1804 of 2008 have been filed and application under the Domestic Violence Act has also been moved before the Human Rights Commission.
Learned counsel for the petitioners-A1 to A3 submits that the dispute has been settled among the family members and the petitioners herein are not interested to pursue with the matter. He, therefore, requests that liberty may be granted for taking appropriate steps available under law for getting the accused discharged before the Court below.
In view of the above submission, the Criminal Petition is dismissed with the liberty as sought for. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
