THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 12193 OF 2017 O R D E R :

The action of the 2nd respondent Corporation in issuing proceedings dated .04.2016, by which the 3rd respondent was granted provisional NOC for installation of cell tower at premises bearing D.No. 61-22/4-15, R.S.No. 54/2,3, Rajith Bhargava Road, Near Community Hall, Ramalingeswara Nagar, Vijayawada is questioned in this Writ Petition on the ground of violation of the guidelines issued in G.O.Ms. No. 146, Municipal Administration & Urban Development (M2), dated 19.06.2015.

The grievance of the petitioner is that opposing the erection of cell tower in the premises mentioned supra, they have submitted the representation dated 25.04.2016 to the 2nd respondent bringing to his notice particularly the threat of radiation and other aspects, but the same has not been considered so far. Heard learned counsel for the petitioner as well as Sri R. Sudheer, learned Standing Counsel for the 2nd respondent Corporation.

Since it is the case of the petitioner that the objection raised by him for erection of the cell tower in the premises belonging to the 4th respondent, through the representation dated 25.04.2016, has not been considered, it would be suffice if a direction in that regard is issued to the 2nd respondent.

The Writ Petition is therefore, disposed of directing the 2nd respondent to consider the representation dated 25.04.2016 of the petitioner, in terms of G.O.Ms.No. 146, dated 19.06.2015 within

eight weeks from the date of receipt of a copy of this order. No costs.

Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
