O R D E R
Aggrieved by the inaction of respondents 2 to 5 in considering the representation of the petitioner dated 23.08.2018, seeking for police protection at the Environmental Public Hearing, scheduled on 18.09.2018 at 10.30 a.m. at the existing plant area in Sy.Nos. part of 289 to 292 situated at Veliminedu village, Chityal Mandal, Nalgonda District, for the proposed expansion of the production capacity of existing Bulk Drug Unit and Intermediates Manufacturing Unit; the present writ petition is filed.
Learned counsel for the petitioner would submit that this court in similar facts and circumstances in W.P.No.4542 of 2017, dated 13.02.2017, disposed of the writ petition permitting the petitioner therein to submit representation to the Superintendent of Police, Sangareeddy District, and he was directed to take a decision whether to provide police bandobast, and in case he is inclined, the same shall not result in individuals, other than locally affected persons, being prevented from being present during the course of environmental public hearing. He submits that similar directions may be passed in the present writ petition. Learned Assistant Government Pleader for Home, does not dispute the submission of the learned counsel for the petitioner. Since the Environmental Public Hearing is stated to be scheduled on 18.09.
2018 and the petitioner made representation on 23.08.2018, the 2nd respondent - Superintendent of Police, Nalgonda District, is directed to examine the petitioner's contention of the possibility of breach of peace and breakdown of law and order, and take an appropriate decision in accordance with law, within a period of three days from today, whether or not police bandobasth should be provided.
