SMT JUSTICE T.RAJANI CRIMINAL PETITON No.8255 OF 2011 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in C.C.No.715 of 2011 on the file of VIII Metropolitan Magistrate, Cyberabad at Rajendranagar, registered for the offences punishable under Sections 498-A and 309 IPC and Sections 3 and 4 of the Dowry Prohibition Act, against the petitioners/A.2 to A.5.

Heard learned counsel for the petitioners and the learned Public Prosecutor.

Learned Public Prosecutor submits that in this case charge sheet is already filed, therefore, the petitioners may be directed to seek appropriate relief in the lower Court by filing discharge petition.

A perusal of the complaint, prima facie shows some allegations against the petitioners.

Hence, considering the above facts, the Criminal Petition is dismissed. However, the petitioners are at liberty to file a discharge petition before the Court below. Considering the request of petitioners, the Court below is directed not to insist upon the presence the petitioners before the Court, unless it is required for the proceedings of the case.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
