ORDER:

This Contempt Case is filed alleging willful disobedience of order, dated 17.04.2012 passed in Writ Petition No.31131 of 2011. Alleging willful violation of the above-mentioned order, the petitioners have filed Contempt Case No.227 of 2014. In the said Contempt Case, the respondents have reported that they have issued proceedings implementing the order of this Court. Placing on record the said fact, this Court has closed the Contempt Case by order, dated 24.11.2014.

The grievance of the petitioners is that even though the respondents have issued bills to the tune of Rs.49,79,826/-, the officials of the District Treasury have not honoured the bills by raising certain objections and therefore, the petitioners have caused legal notice, dated 08.03.2015 on them. As they have failed to comply with the said treasury bills even after issuance of the said statutory notice, they have filed the present Contempt Case by impleading the District Treasury officials as respondents 3 to 5 with an application to leave for such impleadment. However, this Court by order, dated 14.08.2015 dismissed the said application.

Learned counsel for the petitioners submitted that after dismissal of the said application, the petitioners have filed Writ Petition No.7491 of 2015 and secured an interim order against the said respondents.

In the light of these subsequent events, nothing survives in the present Contempt Case. If the Treasury officials failed to honour the interim order passed by this Court in the above-mentioned Writ Petition, the petitioners shall be free to avail

appropriate remedy for enforcement of the said interim order. Subject to the liberty given to the petitioners as above, the Contempt Case is dismissed.
