HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31511 OF 2018 ORDER :
This writ petition is filed challenging the action of the 3rd respondent in insisting the petitioner and his father to come and surrender the vehicle in the 3rd respondent police station without following due process of law.
Learned Assistant Government Pleader for Home produced written instructions stating that only for the purpose of investigation in Crime No.290/2018, registered under Sections 420, 406, 506 IPC, dated 24.05.2018, petitioner was issued notice under Section 41 A Cr.P.C. to appear before the Investigating Agency along with relevant documents with regard to subject vehicle i.e. INNOVA Car bearing No.AP 09 CW 0100, to know as to how the petitioner became owner of the said vehicle, but, instead of cooperating with the investigation, petitioner filed present writ petition. Learned counsel for the petitioner submits that the petitioner has already provided necessary information and particulars about the subject vehicle.
In view of the same, recording the written instructions submitted by the learned Assistant Government Pleader, the writ petition is disposed of directing the respondent police not
to interfere with the life and liberty of the petitioner, except in accordance with law. No order as to costs.
