HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31494 OF 2010 ORDER:

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in not taking the action against the illegal occupiers and removing illegal structures from Chudi Bazar Grave Yard as per Section 54 & 55 of the Wakf Act, 1995.

Though, no counter is filed by the 1st respondent, Sri M.A.K.Mukheed, learned Standing Counsel for the 1st respondent submits that necessary action will be initiated under Section 54 of the Wakf Act, 1995.

Counter affidavit is filed by the 6th respondent stating that the police are not the competent authority to remove the illegal encroachments in the subject Wakf property.

In view of the same, the 1st respondent is directed to take appropriate action as per Section 54 of the Act. With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
