THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.28057 of 2015 ORDER:

Heard the learned counsel for petitioner, the learned Government Pleader for first respondent and the learned Standing Counsel for respondents 2 to 4.

It is the case of the petitioner that he was running a hotel in survey No.270(p), Phase-II, IDA Charlapally, Ghatkesar Mandal, Ranga Reddy District under a lease agreement dated 08.10.2006 executed by respondents 3 and 4. When some unauthorized persons were doing the same business in and around the area, the petitioner submitted several representations, including the representations dated 21.06.2015 and 21.07.2015, to respondents 2 to 4, and when the same were not considered, the present writ petition is filed.

3. The learned counsel for the petitioner submits that the area is an industrial area and it comes under the jurisdiction of respondents 3 and 4. Since the petitioner is a lessee, respondents 3 and 4 ought not to have permitted unauthorized persons to do the same type of business in and around the area leased out to him.

The learned Standing Counsel for respondents 2 to 4 submits that no permission was granted to any person, but however, respondents 2 to 4 would consider the representation submitted by the petitioner.

He further submits that no representation was given to respondents 3 and 4 who are having supervision over that area.

In the circumstances, the Writ Petition is disposed of giving liberty to the petitioner to submit a detailed representation to respondents 3 and 4 within a period of one week from the date of receipt of a copy of this order. On receipt of such representation, respondents 3 and 4 shall consider the same and take necessary action in that regard as expeditiously as possible. There shall be no order as to costs. The miscellaneous petitions pending, if any, shall stand closed.
