ORDER:

The grievance of the petitioner, who claims to be the occupier of the building constructed by respondent No.3, is that despite his representations to respondent Nos.1 and 2 to examine whether respondent No.3 obtained building permission for constructing ground + two floors building and if not, to take action for demolition of the same, no action is being taken.

On 29.4.2015, Mr. P. Krishna Reddy, learned Standing Counsel for the Greater

Hyderabad Municipal Corporation, took notice for respondent Nos.1 and 2 and sought time for getting instructions. Today, at the hearing, there is no representation for respondent Nos.1 and 2.

In my opinion, respondent Nos.1 and 2 cannot be indifferent to the grievance of the petitioner. Hence, they are directed to examine whether respondent No.3 has obtained any building permission. If they find that either he has not obtained building permission, or constructed the building in deviation of the sanctioned plan, they shall take action under the provisions of the Greater Hyderabad Municipal Corporation Act, 1955, after following due procedure. They shall complete this exercise within two months from the date of receipt of this order. Subject to the above directions, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.17215 of 2015 shall stand disposed of as infructuous.
