THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 31514 of 2018 ORDER:

Petitioners assert that their father was assigned land to an extent of Acs.4.47 cents situated at Naruva Revenue Village, Ranasthalam Mandal, Srikakulam District and pattadar pass books and title deeds were issued in his favour; that after demise of their father, they approached respondent No.1 - Tahsildar, Ranasthalam Mandal, Srikakulam District, for issuance of pattadar pass books in their favour, but, he refused to issue the same on the ground that the said land was resumed by the Government vide proceedings bearing RC.No.345/2002 issued by respondent No.2 - Revenue Divisional Officer, Srikakulam Division, Srikakulam, and that no notice was issued to their father before issuing such proceedings. Hence, they filed this Writ Petition seeking to declare the action of respondent No.2 in issuing the said proceedings without notice to their father, as illegal and arbitrary.

Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents.

CKR, J WP.No.31514 of 2018 It may be noted that though the petitioners questioned the action of respondent No.2 in issuing proceedings bearing RC.No.345/2002 with respect to resumption of the land assigned to their father, they did not choose to file the same along with this Writ Petition. Therefore, no relief can be granted in favour of the petitioners. However, it is open for the petitioners to approach the authority concerned and obtain a copy of such proceedings and thereafter, challenge the same in accordance with law. With the above observations, this Writ Petition is disposed of.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
