THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.53 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in SC.NDPS.No.90 of 2019 on the file of Metropolitan Sessions Judge, Hyderabad, registered for the offence under Section 8 (c) r/w. 20(b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner and others were involved in the case for being in possession of 4kgs. of ganja. The crime was registered on 20.07.2019 and thereafter, the charge sheet was filed in the same year. However, for his absence on 23.08.2023, the Court below issued non-bailable warrants which were executed by the Police on 08.09.2023 and he was remanded.

Learned counsel appearing for the petitioner would submit that from the year 2019 till 2023, the petitioner was attending the

Court regularly, it was solitary instance that he was not present on 23.08.2023.

However, keeping in view the quantum of contraband seized and petitioner was appearing before the Court below since 2019, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:- i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each to the satisfaction of the Metropolitan Sessions Judge, Hyderabad.

ii) The petitioner/Accused No.3 after release shall appear before concerned Court on every date of hearing. iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
