THE HON'BLE SRI JUSTI CE SANJAY KUMAR CI VI L REVI SI ON PETI TI ON No.2529 of 2017 ORDER:
This civil revision petition under Article 227 of the Constitution arises out of the docket order dated 02.01.2017 passed by the I Additional Senior Civil Judge, Ranga Reddy District at L.B.Nagar in I.A.No.54 of 2017 in O.S.No.692 of 2014. The said I.A. was filed by the defendants in the suit to set aside the ex parte decree passed in the suit. Taking note of the fact that the delay in filing the said application had already been condoned in I.A.No.177 of 2016, the Court below allowed the subject I.A. with the condition that the defendants should pay half the decretal amount to the respondent/plaintiff. The suit was directed to be put up for setting aside the decree upon compliance with this condition. By order dated 09.06.
2017, this Court took note of the grievance of the petitioners/defendants that the Court below had directed payment instead of deposit to the credit of the suit and accordingly directed the petitioners/defendants to deposit half the decretal amount to the credit of O.S.No.692 of 2014 on the file of the learned I Additional Senior Civil Judge, Ranga Reddy District. This Court is now informed that this condition has been complied with.
In view of the fact that the scope of this revision was limited only to this grievance of the petitioners/defendants and as the amount in terms of the conditional order passed by the Court below has now been deposited to the credit of the suit, it is for the Court below to proceed further in the matter.
Granting liberty to the Court below to do so, the civil revision petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
