HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31554 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents 3 and 4 in deciding the title and possession pertaining to the land of the petitioners admeasuring Ac.8.00 cents, situated at Sy.No.16/17 of K. Rampur Village, Untoor Mandal, Adilabad District and trying to dispossess the petitioners from the subject land, without following due process of law, as illegal and arbitrary. The grievance of the petitioners is that they are the absolute owners and possessors of the above said property as it was inherited from their father and they have been in possession and enjoyment of the same. While things stood thus, the 3rd respondent directed the Mandal Surveyor, Utnoor to conduct a survey, for ascertaining the title and possession and also the actual survey number of the land, without issuing any prior notice to the petitioners. It is further stated that on 27.6.2018, the Mandal Surveyor, Utnoor and the Village Revenue Officer, K. Rampur came to the land of the petitioners and conducted a Panchanama.
When the matter is taken up for hearing, the learned Government Pleader for Revenue, would submit that the writ petition may be disposed of directing the respondent-authorities to follow due process of law while dispossessing the petitioners.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondents 3 and 4, to follow due process of law, before taking any steps to dispossess the petitioners from the subject lands, if the petitioners are in possession of the same. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
