THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION NO.2227 OF 2011 ORDER:

This civil revision petition is filed under Article 115 of the Constitution of India, challenging the order in C.M.A.No.2 of 2009 dated 07.03.2011 passed by the Senior Civil Judge, Mangalagiri, whereby, the said C.M.A.No.2 of 2009 was allowed setting aside the order and decree dated 20.01.2009 passed in I.A.No.834 of 2007 in O.S.No.148 of 2007 on the file of Principal Junior Civil Judge, Mangalagiri.

During hearing, learned counsel for the respondents expressed his doubt about pendency of the suit itself. However, both parties agreed to continue the interim injunction, which was in force for the last 10 years and requested this Court to issue a direction, without touching any merits, to the trial Court to decide the main suit as expeditiously as possible.

Acceding to the request of both parties, the revision petition is disposed of directing the Principal Junior Civil Judge, Mangalagiri to dispose of the O.S.No.148 of 2007, if pending, in accordance with law as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order. No costs.

The miscellaneous petitions pending, if any, shall also stand closed.
