THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CONTEMPT CASE No.1075 of 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Contempt Case, under Sections 10 to 12 of the Contempt of Courts Act, is filed alleging willful disobedience to the order, dated 28.08.2014, in WAMP.No.2714 of 2014 in W.A.No.1134 of 2014, which reads as under:

"As it is submitted that the petitioner has already installed fire equipment set and the application for 'No Objection Certificate' is still pending consideration, until further orders, there shall be interim stay of demolition.

In the meanwhile, the petitioner shall pursue his application before the authorities so as to produce the same before the Government to consider his application for regularization." In this contempt case, it is contended by learned counsel for the petitioner that pursuant to the aforesaid order, though the petitioner has furnished 'No Objection Certificate' and other required certificates, the respondents are not considering her application for regularization and, as such, there is violation of the directions issued by this Court.

In the order dated 28.08.2014, there is no direction for regularization, and therefore, we are unable to accept the submission of the learned counsel for the petitioner that the respondents have violated the orders passed by this Court. In the said order, this Court has merely observed that the petitioner shall pursue her application before the authorities so as to produce the same before the

Government to consider her application for regularization. If the petitioner's application is not considered for regularization or penalisation, it is open to her to seek appropriate directions by filing appropriate application, but it cannot be said that the respondents have violated the directions of this Court.

Subject to the above observations, the contempt case is closed.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
