HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30493 OF 2016 ORDER:
The petitioner claims to have interest in the land situated in Sy.No.28/2 admeasuring Ac.3.90 cents and the land in Sy.No.28/3 admeasuring Ac.3.18 cents of Kommadi Village, Visakhapatnam, having paid the substantial amounts towards sale consideration to vendors. Petitioner further stated that as per the proceedings of the 2nd respondent dated 12.06.2003, the names of the alleged vendors of the petitioner in respect of the subject lands is reflected in the revenue records. The grievance of the petitioner is that without issuing notice to him, the 3rd respondent passed impugned order on an application made by the respondent Nos.23 and 24 for conversion of agricultural land into non-agricultural land in respect of the land in question.
Though various contentious issues are raised by the learned counsel for the petitioner assailing the correctness of the impugned order, passed by the 3rd respondent and consequent issue of pattadar pass books and title deeds in favour of the respondent Nos.23 and 24, the learned Assistant Government Pleader for Revenue submitted that there is an efficacious alternate remedy of appeal available under Section 8 the Andhra Pradesh Agricultural Land (Conversion for Non-Agricultural purpose) Act, 2006 which is not disputed by the learned counsel for the petitioner.
In view of the same, I am not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed giving liberty to the petitioner to avail alternative remedy available under Section 8 of the Act. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 14-10-2016 dv
