HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION NO:23158 OF 2010 ORDER:

1. This writ petition is filed challenging the order passed by the 1st respondent dated 12.7.2010 demanding the petitioner to pay Rs.1,45,97,918.50 p.s., towards RNFC, TNLC and Landing Charges.

2. The petitioner is running a training school since 1999 for providing training in flying, maintenance Engineering and in other fields of Aviation. The Airport Authority of India, Hyderabad Air port had given the license to the petitioner to use the land and space for construction of hanger at Begumpet Airport and Nadirgul Airfields, and entered into agreement of license for the period from 15.10.1999 to 31.3.2002 initially. The said license period was extended from time to time and it would be in force till 31.3.2011. In pursuance of the said license, the petitioner constructed the hanger at Begumpet Airport and Nadirgul Airfield and operated the training flights both at Begumpet Airport and Nadirgul Airfield. While so, the 1st respondent issued impugned order demanding the petitioner to pay the dues for their flying operations at Hyderabad Airport and Nadirgul Airfield.

3. When this matter has been taken up, the learned Counsel appearing for the petitioner submitted that the respondents supplied the bills and also the list of charges to be paid by the petitioner. He further submitted that there is some dispute regarding the payment of charges claimed by the 1st respondent and that the charges, for which the 1st respondent is not entitled, were included in the bills and therefore, the petitioners prayed this Court to direct the respondents to consider the representations that would be given by the petitioner in connection with the above facts, and dispose of the same as early as possible.

4. Considering the above facts and circumstances of the case, without expressing

any opinion on the merits of the case, the Writ Petition is disposed of with the following direction:

"The petitioner is directed to give a representation detailing the entire grievance, within a period of one month from the date of receipt of a copy of this order. On such representation being made, the 1st respondent is directed to consider the same in proper perspective and pass appropriate orders, after giving sufficient opportunity to the petitioner, within a period of three months thereafter. Till completion of such process, the respondents are directed not to take any coercive steps in relation to the bills for the period upto 2009."

No order as to costs. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
