HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.15649 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Cr.P.C. to modify the order dated 29-1-2016 in Crl.R.P.No.192 of 2015 passed by the XV Additional Sessions Judge, Ranga Reddy District at L.B.Nagar whereby the District Judge directed the petitioner to execute a bond for Rs.15,00,000/- with one surety, while, ordering interim custody of Innova car bearing No.TS 07 EC 7128 during the pendency of the proceedings before XIX Metropolitan Magistrate, Kukatpally, at Miyapur, Ranga Reddy District.. The contention of the petitioner is that Innova car bearing No.TS 07 EC 7128 is a second hand vehicle and it was in the custody of police for a period of one year exposing to rain and sun and becoming useless and in such a case, insisting execution of bond for Rs.15,00,000/- is burden some and requested this court to reduce the same.

Taking into consideration of the condition of the vehicle as pointed out by counsel for the petitioner, I find it a fit case to reduce the surety amount from Rs.15,00,000/- to Rs.10,00,000/- (ten lacs.) with one surety for the like sum.

Accordingly, the order impugned is modified.

The learned Magistrate is directed to order for release of Innova car bearing No.TS 07 EC 7128 on the same other conditions

as imposed by the XV Additional Sessions Judge, Ranga Reddy District at L.B.Nagar.

Accordingly, this Criminal Petition is disposed of. As a sequel to the disposal of this petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed. __________________________________ JUSTICE M.SATYANARAYANA MURTHY Dated 3-11-2016.
