ORDER

Heard learned counsel appearing for the petitioner, learned Government Pleader for Medical and Health appearing for the 1st respondent and learned Standing Counsel appearing for the 2nd respondent-Company.

The case of the petitioner is that the 2nd respondent issued a tender notification dated 13.6.2017 calling for tenders for providing health care to the employees and their dependants at Project Hospital at Nelatur Village, Muthukur Mandal, Nellore District.

The contract is for the period from 1.8.2017 to 31.03.2020 (34 months). The last date for submission of bid was 29.06.2017 and the technical bid was opened at 4.00 P.M on 29.06.2017. The date & time fixed for price bid was at 4.00 P.M on 6.7.2017. It is stated that this is the fourth round of tender, since the earlier attempts failed. The present writ petition is filed apprehending that the tenders are going to be finalized without adhering to the tender conditions, more particularly, the

condition of giving preference to the bidder belonging to the State of A.P.

Learned Standing Counsel submits that two tenders were received and the technical bid itself is not scrutinized so far. It is not known as to why the technical bid was not scrutinized when the contract period commences from 1.8.2017. Be that as it may, this writ petition is disposed of by directing the respondents to adhere to the terms and conditions of the tender while scrutinizing the bids and go ahead with the bid process. If for any reason, the respondents take a decision to cancel the bid, it is open to the respondents to take appropriate decision during the period of scrutiny. No costs.
