THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31510 of 2018 ORDER:

An affidavit deposited by Shaik Meera Saheb is filed on behalf of the petitioner herein requesting one year time to vacate the subject premises.

The same is strongly opposed by the learned Standing Counsel, on instruction.

By way of the impugned notice bearing Roc.No.129702/2017-F2, dated 20.08.2018, the respondentMunicipal Corporation directed the petitioner herein to close down the cement godown, within a period of 48 hours. It is submitted by the learned Counsel for the petitioner that the petitioner herein has taken all the precautionary measures to curb the pollution and despite which, the respondent-authorities issued the impugned Order. It is the further submission of the learned Counsel that the godown has been in existence for the last 20 years. As mentioned supra, now an affidavit is filed requesting one year time to vacate the premises.

Having heard the learned Counsel for the petitioner and the learned Standing Counsel and taking into consideration the long standing existence of the godown in the subject premises and to have a quietus for this issue, six months time is granted from today to vacate the premises. The respondent-authorities are directed to open the locks of the subject premises. The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
