THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.31559 of 2018 ORDER:

In this writ petition under Article 226 of the Constitution of India, the grievance of the petitioners is non-consideration of their objections, dated 02.08.2018 and 24.08.2018.

I have heard the submissions of the learned counsel for the petitioners and of the learned Government Pleader for Land Acquisition appearing for the respondents 1 to 4 and perused the material record.

The Government have acquired a huge extent of the land of Ac.175.25 1⁄2 gts situated in Lankapally and Gowraram Villages, Penuballi and Bhuvanapalem Mandals of Khammam District, for public purpose, namely, construction of a new broad gauge Railway line from Bhadrachalam to Sattupalli. A notification was issued, on 05.06.2018. The petitioners were required to submit their objections within 60 days; but, they submitted their objections with a delay of three days. However, no declaration has been published. In that view of the matter, there are no impediments for consideration of the objections of the petitioners, is the submission of the learned counsel for the petitioners.

Learned Government Pleader fairly submits that a declaration has not yet been published and that the Land Acquisition Officercum-Revenue Divisional Officer, the 1st respondent herein, will

consider and dispose of the objections of the petitioners in accordance with law, within four weeks.

In the result, the Writ Petition is allowed directing the 1st respondent i.e., the Revenue Divisional Officer-cum-Land Acquisition Officer to consider and dispose of the objections of the petitioners, dated 02.08.2018 and 24.08.2018, within four weeks from the date of receipt of a copy of this order and communicate the decision taken thereon to the petitioners within a week thereafter.

As a sequel, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
