HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.38596 of 2016 ORDER:

This writ petition is filed with the following prayer: ".......to issue an appropriate writ, order or direction more particularly a writ in the nature of Mandamus under Article 226 of Constitution of India declaring the inaction of the 2nd respondent in not issuing No Objection Certificate in terms of G.O.Ms.No.307, dated 06-06-2013 Revenue (Assignment-I) Department despite favourable reports submitted by the respondents 3 and 4, as illegal, arbitrary and violative of Article, 14, 21 and 300-A of the Constitution of India and consequently direct the 2nd respondent to issue NOC certificate forthwith in respect of Ac.0.10 cents in S.No.143/1 in Kothavalasa village and Mandal, Vizanagaram District." The G.O.Ms.No.307, dated 06-06-2013 issued by the Government is superceded by G.O.Ms.No.279, dated 04-07-2016 dispensing with the grant of 'No Objection Certificate' (NOC), in case pattas are granted more than 10 years ago. By virtue of said G.O., No NOC is required. As such, no direction can be issued in terms of G.O.Ms.No.307, dated 06-06-2013.

Accordingly, the writ petition is dismissed. The petitioner has to work out his remedies in terms of G.O.Ms.No.279, dated 04-07-2016. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
