THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.2400 of 2013 ORDER:

The petitioner/accused seeks to quash the proceedings in Cr.No.438 of 2012 on the file of S.R.Nagar Police Station, Hyderabad, whereunder the petitioner was charged for the offences under Sections 427 and 447 IPC.

When the matter came up for hearing, learned counsel for Respondent No.2/complainant producing copy of charge sheet submitted that since charge sheet has been filed, the instant petition became infructuous.

Learned counsel for petitioner did not object and requested to grant liberty to challenge the charge sheet by way of an appropriate application.

In view of the above respective submissions, this Criminal Petition, which is filed for quashment of the proceedings in Cr.No.438 of 2012, is dismissed as infructuous and liberty is given to the petitioner to challenge the charge sheet by way of an appropriate application.

Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
