THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2299 of 2016 ORDER:

This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioners-Accused Nos.1 to 5 seeking to quash the proceedings against them in Crime No.30 of 2016 on the file of Women Police Station, Hyderabad City. Heard and perused the material available on record. The offences alleged against the petitioners are punishable under Section 498-A IPC. The truth or otherwise of the above allegations can be ascertained during the investigation of the case. Hence, this Court is not inclined to interfere with the investigation. At this stage, learned counsel for the petitioners submitted that in view of the pendency of the above crime, the petitioners apprehend arrest and also the harassment in the hands of the police.

In view of the above and since the present case arises out of matrimonial dispute, the police concerned are directed to complete the investigation without arresting the petitioners and file final report, if any, in accordance with law. The petitioners are directed to appear before the Investigating Agency as and when their presence is required and cooperate with the investigation. With the above directions, the criminal petition is disposed of. Miscellaneous petitions pending in this criminal petition, if any, shall stand closed.
