THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.4261 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure seeking to quash the proceedings initiated against the petitioners in Crime No.220 of 2015 of Bapatla Town Police Station, Guntur District, registered for the offences punishable under Sections 120 B, 468, 471 and 420 IPC read with section 34 IPC.

Heard and perused the material.

On perusal of the entire material available on record, prima facie, there are specific allegations against the petitioners, which are to be investigated into by the police. Hence, this Court is not inclined to quash the impugned proceedings at this stage. Considering the facts and circumstances of the case, the police are directed to complete investigation without arresting the petitioner and file final report, if any, in accordance with law. In the event of necessity, the police concerned are at liberty to issue a notice to the petitioner herein for the purpose of investigation and on receipt of such notice the petitioners herein shall appear before the police and cooperate with the investigating agency. In the event of failure on the part of the petitioner to appear before the police on receipt of such notice, the police are at liberty to approach this Court for recalling the present order. The Criminal Petition is accordingly disposed of.

Miscellaneous Petitions pending in this Criminal Petition, if any, shall stand closed.
