THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.20664 OF 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondent authorities in not considering the request of the petitioner for restoration of possession of assigned property admeasuring Ac.2-87 cents in Survey No.74/4 of Neellarevu Village, Hamlet of Brahmasamedyam Village, Katrenikona Mandal, East Godavari District, as illegal and arbitrary. The case of the petitioner is that his father was assigned the subject land through D-Form Patta bearing Ref.B2/5693/1974, dated 26.11.1980. After demise of his father in the year 2002, respondent No.5 highhandedly encroached the subject land in contravention of the provisions of A.P. Assigned Lands (Prohibition of Transfers) Act, 1977. As such, he made representations for restoration of the subject land. As no action has been taken yet on the same, the present Writ Petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader for Revenue produced written instructions, dated 27.06.2016, wherein it is stated that the subject land was inspected

and found to be in possession of son of respondent No.5 and notices were issued to the occupier of the subject land on 27.06.2016 and action is being taken for restoration of possession of subject land to the petitioner. Recording the same, the Writ Petition is disposed of directing respondent No.4 to take appropriate action in pursuance of the notice, dated 27.06.2016, in accordance with law and restore possession of the subject land to the petitioner within a period of two months from the date of receipt of a copy of this order.

Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
