THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO Crl.P.M.P.No.3275 of 2015 AND Crl.P.No.2395 of 2015 COMMON ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. to quash PRC No.28 of 2013 on the file of Judicial First Class Magistrate, Kovuru, SPSR Nellore District.

Crl.P.M.P.No.3275 of 2015 is also filed under Section 482 Cr.P.C. to record compromise between petitioners 1 to 3 in the Criminal Petition and respondents 1 to 3 therein. Respondents 1 to 3 have engaged Sri M.Babji as their counsel. The petitioners as well as respondents 1 to 3 are present in person and they have been identified by their respective counsel. Charge sheet has been filed against the petitioners on a complaint lodged by respondents 1 to 3 alleging that the petitioners in the Criminal Petition committed offences punishable under Section 323 read with 34 IPC and Section 3(i)(x) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. It is alleged in the charge sheet that the dispute arose between the petitioners and respondents 1 to 3 in relation to use of a Donka Poramboke in respect of their land, which is being used allegedly as a grave yard.

Learned counsel as well as parties of both sides who attended today before the Court have stated before this Court that on the advise of village elders and well wishers, they have compromised the matter and respondents 1 to 3 in the Criminal Petition have decided not to prosecute the criminal case in PRC No.28 of 2013 on the file of Judicial First Class Magistrate, Kovur, SPSR Nellore District, and have agreed for quashing of the said PRC in view of the settlement

between the parties. It is further stated that both parties have no issues with each other and will not claim anything whatsoever against each other, having so settled amicably.

Respondents 1 to 3 were examined in the Court and stated that they agreed for this compromise voluntarily and without any coercion. Having regard to the settlement dated 02.04.2015 entered into by the parties and in the interest of harmony, this Criminal Petition is allowed and PRC No.28 of 2013 on the file of Judicial First Class Magistrate, Kovur, SPSR Nellore District, is hereby quashed in terms of the said compromise. Crl.M.P.No.3275 of 2015 is also allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
