ORDER:

This company petition is filed for an order to wind up the respondent-company for non-payment of the debt due to the petitioner. At the hearing, Sri Avinash Desai, learned counsel for the respondent, has placed before the Court demand draft, dated 29.08.2015, for a sum of Rs.2,91,704/-, drawn in favour of the petitioner towards full and final settlement of the latter's claim. Sri M.S.Chandresh, learned counsel for the petitioner, has received the

demand draft and requested the Court to close the company petition in view of the settlement reached between the parties and the payment made by the respondent in pursuance of such settlement.
