HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4782 of 2015 O R D E R:

The petitioner, who is accused No.1 in Crime No.23 of 2015 on the file of Ozili Police Station, SPSR Nellore District, registered for the offence punishable under Sections 323 r/w 34 IPC and Section 3 (1)(x) of the SCs & STs (POA) Act, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. Heard and perused the material available on record. Learned Counsel for the petitioner submitted that the petitioner has not committed any offence as alleged and there are no serious allegations against him. There is a bar for granting anticipatory bail in connection with the offence under the SCs & STs (POA) Act. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner is at liberty to surrender before the Magistrate/Court below concerned and move an application for bail. On such surrender, the said Magistrate/Court below shall consider the bail application and pass appropriate orders on the same day.
