Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for shop No. 39 of A.L.Puram village, Gudipala Mandal, Chittoor District. It appears that on the basis of the report submitted by the Deputy Tahsildar, Civil Supplies, Gudipala on 25.07.2014, a show cause notice was issued by the third respondent on 31.3.2015 framing as many as six charges against the petitioner.

The authorization of the petitioner was also suspended on 10.09.2014 pending enquiry. Challenging the same, the petitioner preferred an appeal to the second respondent, who granted stay at the time of admission of the appeal and the appeal was ultimately disposed of on 19.3.2015

directing the third respondent to complete the enquiry within a period of four weeks from the date of receipt of a copy of the said order. The petitioner submitted his explanation on 8.4.2015 denying the charges levelled against him. The third respondent without properly considering the same, cancelled the authorization of the petitioner by order dated 13.4.2015. Against the said cancellation, the petitioner preferred an appeal to the second respondent and the second respondent by order dated 14.08.2015 remanded the matter to the third respondent for conducting an enquiry afresh into the matter and pass appropriate orders. When no orders are passed by the third respondent, the present Writ Petition is filed. In view of the order passed by the second respondent on 14.8.

2015 remanding the matter to the third respondent for conducting de novo enquiry, the third respondent is directed to conduct an enquiry into the allegations levelled against the petitioner afresh as directed by the second respondent supra and pass appropriate orders thereon within a period of thirty days from the date of receipt of a copy of this order by giving due opportunity to the petitioner.

The Writ Petition is disposed of accordingly at the admission stage. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
