THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39342 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of certiorari calling for the records pertaining to F.I.R.No.207 of 2016 pending on the file of the second respondent and declare that investigating into the same despite there being a representation submitted by the third respondent not to proceed further is illegal and arbitrary and consequently quash the F.I.R. Heard and perused the material.

When the matter is taken up for hearing, learned counsel for the petitioner submits that the complainant/third respondent filed an affidavit stating that she is not interested to prosecute the case against the petitioner due to the intervention of the elders and that the matter is settled out of the court. The complaint/third respondent and the petitioner appeared before this Court.

This Court also enquired the complainant/third respondent regarding her intention whether to proceed further or to quash the proceedings and she submitted that she is not interested to proceed further due to the intervention of the elders and to that effect, she also filed an affidavit. Considering the facts and circumstances of the case and also as the petitioner herself filed an affidavit stating that she is not interested to prosecute the matter further, the F.I.R.No.207 of 2016 registered against the petitioner for the offences under Sections 354-A and 506 IPC is hereby quashed.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.12.2016 pln
