Icici Lombard General Insurance Company Limited v. Sri B.Yadi Reddy

HON'BLE SRI JUSTICE A.V. SESHA SAI CIVIL MISCELLANEOUS APPEAL No. 1120 OF 2009 ORDER:

On reference to the Lok Adalat, the Lok Adalat, on 13.08.2016, passed the following award:

"The above case between the parties having been referred for determination to the Lok Adalat and the parties having compromised the case/matter, the following Award is passed in terms of the settlement: 1.

Sri Akshay Kumar Kulkarni, Legal Officer for ICICI Lombard General Insurance Company Limited and Smt. A. Chaya Devi, learned counsel for the Applicants. Both parties are present. 2.

It is stated that both the parties have amicably settled their dispute and in pursuance of the compromise between them, the applicants have agreed to receive Rs.3,01,383/- as against the awarded amount of Rs.4,01,843/- in full quittance against the insurance company. 3.

It is stated that the respondent insurance company has already deposited the entire amount as per the award. Accordingly, award is passed for the above said amount of Rs.3,01,383/- in favour of the applicants in full quittance of their claim against the respondent insurance company and the respondent shall be entitled to refund of amount of Rs.1,00,460/- along with accrued interest thereon, if any.

The applicants are permitted to withdraw entire amount. 5.

In terms of the compromise arrived at between the parties, this case is disposed of.

The parties are informed that the Court fee, if any, paid by any of them before lower Court shall be refunded."

In view of the above, there shall be a Decree in accordance with the said Award. Accordingly, the Civil Miscellaneous Appeal stands disposed of. Miscellaneous petitions, if any, shall stand closed. No order as to costs. _____________________ A.V. SESHA SAI, J Date: 22.09.2016 ES
