THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3651 OF 2016 ORDER:
This petition is filed by the petitioners-accused Nos.1 and 2 under Section 482 Cr.P.C. seeking to quash the proceedings against them in Crime No.5 of 2016 on the file of Nacharam Police Station, Ranga Reddy District, registered for the offences punishable under Sections 420 and 506 IPC.
Heard and perused the material available on record. It is alleged that the de facto complainant supplied 510 nos., of floor scales total worth Rs.2,48,17,875/- to the petitioners upon the purchase order and the petitioners paid only Rs.40,00,000/- and did not pay the balance amount. Therefore, the de facto complainant filed a private complaint against the petitioners.
Learned Counsel for the petitioners submitted that the present case is registered on the basis of the reference made by the learned Magistrate, without following the due procedure and that the petitioners were already granted anticipatory bail.
Considering the facts and circumstances of the case, the police concerned are directed to investigate into the matter as expeditiously as possible and file final report, if any, in accordance with law. If the petitioners are aggrieved over the final report, if any, filed by the police concerned, they are at liberty to challenge the same. With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
