HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1887 OF 2017 O R D E R :
This contempt case is filed alleging violation of the order dated 22.08.2017 passed by this Court in WP.MP.No.34245 of 2017 in WP.No.27562 of 2017 wherein this Court directed the respondents 3 and 4 to consider the representations of the petitioners in terms of G.O.Ms.No.138, dated 08.08.2017 and take action accordingly.
Heard learned counsel for the petitioners.
Smt.Bobba Vijayalakshmi, learned Standing Counsel for respondents submits that the respondents passed orders rejecting the application of the petitioners vide proceedings dated 05.09.2017.
Learned counsel for the petitioners tried to argue that when G.O.Ms.No.102 dated 27.06.2017 was amended by virtue of G.O.Ms.No.138, dated 08.08.2017 by giving retrospective effect to the original G.O.; and when bank has followed G.O.Ms.No.138, dated 08.08.2017, it has to follow G.O.Ms.No.138.
It is to be seen that this Court directed the respondents in WP.MP.No.34245 of 2017 in WP.No.27562 of 2017 to consider the representation of the petitioners and pass orders. In pursuance of the said orders, the respondents
passed orders rejecting the application of the petitioners. The correctness of the order cannot be challenged in the Contempt Case. In view of the same, I do not see any violation of the order dated 22.08.2017 passed by this Court in WP.MP.No.34245 of 2017 in WP.No.27562 of 2017. Accordingly, the Contempt Case is dismissed. However, it is open for the petitioners to challenge the rejection orders, in accordance with law. No order as to costs.
