THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.28070 of 2012 ORDER :

This Writ Petition has been filed by petitioners alleging that they are in occupation of land in Survey Nos.230/9B and 230/11B of Therani Village, Nagari Mandal, Chittoor District. 2.

The petitioners contend that land admeasuring Ac.0.45 cents in Survey Nos.230/9B and 230/11B is abutting their land; and that they had made a request through representation dt.02.05.2003 to the District Collector, Chittoor for assignment of the land in Survey Nos.230/9B and 230/11B on payment of market value under the Board Standing Orders.

The counsel for petitioners contends that the 2nd respondent had submitted a report to the District Collector, Chittoor in Roc.B/21/05 dt.09.02.2005, referring to the factual position as on that date for consideration of the same by the District Collector, Chittoor, and thereafter, no action has been taken by the District Collector, Chittoor in that regard.

The learned Government Pleader for Assignment, appearing for respondents, states that the District Collector, Chittoor will consider the said representation in accordance with law and communicate his

decision thereon to petitioners within a period of eight (08) weeks from the date of receipt of a copy of this order. 5.

Accordingly, the Writ Petition is disposed of directing the District Collector, Chittoor to pass orders on petitioners'

representation dt.02.05.2002 for alienation on market value basis of land in Survey Nos.230/9B and 230/11B of extent Ac.0.45 cents to petitioners within a period of eight (08) weeks from the date of receipt of a copy of this order. No order as to costs. 6.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
