HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41697 of 2016 ORDER:

The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to direct the 3rd respondent to conduct investigation in Crime No.51 of 2011 on the file of Dammapet Police Station, Khammam District.

Heard and perused the material available on record. The grievance of the petitioner is that on the basis of the complaint lodged by him before the 3rd respondent against two persons, viz., Penuballi Sarvaiah and Penuballi Satyam, the above crime was registered in the year 2011 for the offences under Sections 295, 448, 323 and 294 r/ w.34 IPC, but the 3rd respondent did not choose to conduct investigation.

Considering the circumstances and the grievance of the petitioner, without expressing any opinion on merits, the 3rd respondent is directed to conduct investigation in the above crime, complete the same and file a final report, if any, as expeditiously as possible. With the above direction, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
