HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.13633 of 2016 ORDER :

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused Nos.1 and 2 seeking to quash the F.I.R. No.241 of 2016 on the file of the Nandigama Police Station, Krishna District, registered for the offences under Sections 447, 427, 506 and 290 read with Section 34 I.P.C.

Heard the learned counsel for the petitioners/accused Nos.1 and 2 and the learned Additional Public Prosecutor and perused the material available on record.

Considering the facts and circumstances of the case, the Criminal Petition is disposed of directing the investigating agency to scrupulously follow the conditions stipulated in the judgment of the Apex Court in Arnesh Kumar v. State of Bihar and another1 and also Section 41 Cr.P.C., before taking any coercive steps against the petitioners. Consequently, Miscellaneous Petitions pending in the Criminal Petition, if any, shall stand closed.
