CVNR,J & MSKJ,J WP.40006 of 2016 THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.40006 of 2016 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Aggrieved by the detention of one Md.Imran (for short "the detenu"), the husband of the petitioner, under Sub-Section (2) of Section 3 of the Telangana Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug Offenders, Goondas, Immoral Traffic Offenders and Land Grabbers Act, 1986 (for short "the Act"), this writ petition is filed.
We have heard Mr.M.V.Raj Kumar Gabriel, learned counsel for the petitioner, and the learned Govt. Pleader for Home (TG). A perusal of the detention order shows that, the detenu was allegedly involved in 5 criminal cases in connection with theft of cell phones and cash. Having carefully considered the nature of the offences, we are of the opinion that the alleged activities of the detenu may, at the most, effect the law and order and not the public order, warranting invocation of the provisions of the Act. On this short ground, the impugned detention order, passed by Respondent No.2, dated 26.07.2016, as approved by G.O.Rt.No.1728, dated 05.08.2016, and confirmed by G.O.Rt.No.2147, dated 29.09.2016, is set aside. The detenuMentioned.Imran, S/o.Md.
Sultan, shall be released forthwith from the detention, unless he is required in connection with any other case or crime. Accordingly, the Writ Petition is allowed. No order as to costs.
