THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1456 OF 2017 ORDER:

Heard learned senior counsel for petitioner and learned standing counsel for respondents 2 and 3.

It is the case of the petitioner that some persons claiming to be purchasers from Kadem Yadaiah and others submitted an application for sanction of layout in respect of the land of an extent of Acs.42.33 guntas situated in Survey Nos.566 to 569 of Kondamadugu Village, Bibinagar Mandal, Nalgonda District, before the second respondent and the petitioner filed objections claiming right to the lands. In spite of the same, when the petitioner apprehends that the second respondent is going ahead with the consideration of the application of the purchasers from Kadem Yadaiah and others, the present writ petition was filed.

This writ petition was filed in December, 2016 and was numbered in January, 2017. Now more than one year has elapsed. If the application of the purchasers from Kadem Yadaiah and others for approval of the layout was not considered as of now, the respondents 2 and 3 are directed to consider the objections of the petitioner before considering the application of any person for layout of the land admeasuring Acs.42.33 guntas situated in Survey Nos.566 to 569 of Kondamadugu Village, Bibinagar Mandal, Nalgonda District. It is needless to observe that if the application for layout is already considered, it is open to the petitioner to take appropriate steps in accordance with law.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
