Heard the learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. Petitioner herein claims that he is qualified to be considered against 50% vacancies earmarked for land looser quota. He claims to be in the ST category and states that earlier his name was not recommended by the District Level Committee and he had not by then passed ITI in Electrician Trade. He states that now he has acquired the necessary qualification and has secured the ITI certificate. The present writ petition is filed against the action of respondents inviting the candidates from the said category to submit their original documents for consideration of their cases.
Evidently petitioner's case was not examined and recommended by the District Level Committee and since the petitioner has subsequently secured the necessary qualification, he has to first approach the third respondent and only after his case is referred to the District Level Committee, it can be examined. Hence, the petitioner is at liberty to make appropriate application before the third respondent seeking reference of his case to the 4th respondent for consideration in the category of land loosers.
Writ Petition is therefore disposed of permitting the petitioner to make a representation as aforesaid to the 3rd respondent and the third respondent shall forward the same to the District Level Committee expeditiously as soon as the application
from the petitioner is received. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
