The prayer of the petitioner in this Writ Petition is as under: "... to issue writ, order direction more particularly in the nature of writ of mandamus declaring the action of respondent No.2 in not re-issuing the passport No.B 0653285 as illegal, arbitrary and violation of Article 21 of the Constitution of India and consequently direct respondent No.2 to pay damages of Rs.20 lakhs to the petitioner and pass such other order or orders as this Hon'ble Court deem fit and proper in the interest of justice."
This Court on 29.7.2009 while issuing notice before admission, permitted the learned counsel for the petitioner to take out personal notice to the respondents by registered post with acknowledgment due and file proof of service. After service of notice, the respondents entered appearance through a counsel. However, no counter-affidavit is filed on behalf of the respondents.
The relief sought for by the petitioner is to direct respondent No.2 to re-issue his passport after expiry of its validity period and the representation dated 07.6.2009 made by the petitioner in that regard is also pending.
As the relief sought for by the petitioner to direct respondent No.2 to consider his representation for re-issuance of his passport is innocuous in nature, without going into the merits of the case, the Writ Petition is disposed of directing the respondents to consider the representation of the petitioner dated 07.6.2009, if not already
considered, in accordance with law and take appropriate action thereon expeditiously. No order as to costs.
As a sequel, Miscellaneous Petitions pending, if any, shall stand closed.
