THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.31627 of 2018 ORDER:

This writ petition is filed by the writ petitioner seeking verbatim the following relief/s:

"...to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not releasing the power supply to the petitioner building at premises bearing Plot No:

7, in Sy.No.102/1, A.P.

Press Photographers Association, Road No:12, Banjara Hills, Hyderabad as illegal, null, void, arbitrary and consequently direct the respondents to release the power supply without insisting for occupancy certificate and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of Justice." At the hearing, Sri N. Mukund Reddy, learned counsel for the petitioner; Sri R. Vinod Reddy, learned Standing Counsel appearing for the respondents 2 & 3; and, Sri Sampath Prabhakar Reddy, learned Standing Counsel appearing for the 4th respondent, stated that the issue involved in this writ petition is squarely covered by the orders of this Court, dated 23.07.2018, in W.P.No.25272 of 2018. A copy of the said order is placed on record.

Having regard to the submissions and for the reasons alike, as were mentioned in the afore-said order, this Writ Petition is disposed of with a direction to the respondents to release the power supply to the premises of the petitioner subject to the compliance of the terms and conditions of supply and on furnishing an undertaking to produce the occupancy certificate from the concerned Municipal Corporation within a period of three months.

If no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action in accordance with law. No order as to costs.

As a sequel, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
