THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO Transfer Criminal Petition.No.128 of 2013 O R D E R:

None appears for the petitioner today when the matter is taken up for consideration. Learned counsel for Respondents 1 to 3 is heard. Respondents 1 to 3 filed M.C.No.15 of 2013 on the file of the Family Court, Khammam, seeking maintenance. The petitioner herein was the sole respondent therein. The husband of the 1st respondent herein and the father of respondents 2 and 3 died. The petitioner herein is the father of the deceased husband of the 1st respondent. He is 75-year-old. He is now residing at Chintal Basthi, Lak-di-kapool, Hyderabad. He, therefore, sought for transfer of M.C.No.15 of 2013 from the Family Court, Khammam to the Family Court at Hyderabad as he is finding it difficult to undertake travel to Khammam as and when required either to appear before the Court or to seek appropriate advice. Hence, he filed this Petition.

The learned counsel for the respondents would submit that for the purpose of educational facilities of respondents 2 and 3, even the 1st respondent has since moved to Hyderabad, though at the time when M.C.No.15 of 2013 was filed, she was residing at Khammam.

Convenience of the parties to prosecute the proceedings is one of the important factors to be taken into account and consideration. Now that both sides are residing at Hyderabad, it would only be in the interest of all concerned to have the matter transferred to the Family Court, City Civil Courts, Hyderabad, so that it can be effectively prosecuted by both sides.

The Transfer Criminal Petition is therefore allowed transferring M.C.No.15 of 2013 pending on the file of the Family Court, Khammam, to the Family Court, City Civil Court, Hyderabad.
